Submission to Environmental Impact Statement



Dear Sir,


We are surprised that the Board has decided that the necessary data was provided in this Environmental Impact Statement.


We were unable to examine the entire Environmental Impact Statement in the offices of the Board during normal opening hours, if fact we asked for the Environmental Impact Statement at 13.15 was asked to return at 14.00 and by 14.45 the whole Environmental Impact Statement had not been made available.


An application to build a pipeline from this terminal to the high water mark has been submitted to the Minister for the Marine, this pipeline which has a significant effect of Special Areas of Conservation sites is an integral part of this development.


There is no regulation under which the Minister of the Marine and Natural Resources is authorised to assess this part of the proposed development.

If this is not included in this assessment, we submit that the Board has no choice but to refuse planning permission this development as a gas terminal with no supply could not be considered sustainable development.


In the alternative this development must be refused as the project splitting is setting out to avoid proper assessment of the total proposed development.


We would also bring to the attention of the Board the following facts:


The Department of the Marine and Natural Resources submitted conditions to Mayo County Council, which were the conditions, attached to the grant of planning permission.


These documents were not placed on the planning file.


The Minister of the Marine informed the Dail that he had no involvement in the planning process relevant to this development.


We wish to refer the Board to the Reasoned opinion of the European Commission re Environmental Impact Assessment and to point out that the Irish Authorities stated to the European Commission that An Bord Pleanala takes all matters re Environmental Impact Assessment into consideration.


Therefore we submit that the advertisement placed by An Bord Pleanala in the - Media is at odds with the stated position of the Irish Government.








The Environmental Impact Assessment Directive states:


2. The information to be provided by the developer in accordance with paragraph 1 shall include at least:

- a description of the project comprising information on the site, design and size of the project,

- a description of the measures envisaged in order to avoid, reduce and, if possible, remedy significant adverse effects,

the data required to identify and assess the main effects which the project is likely to have on the environment,

a non-technical summary of the information mentioned in indents 1-3



We wish in particular to draw the Boards attention to the following:


a description of the project comprising information on the site, design and size of the project,


We submit that to comply with this indent it is essential for the developer to include the entire project and any associated projects, which in our opinion, in this case, means the well head, the offshore pipeline, the pipeline from high water to the terminal, the terminal and the pipeline from the terminal to Craughwell in County Galway.


Evidence was given at the public enquiry into the Bord Gas pipeline that at the present time the only proposal was to build a pipeline to bring the gas from the terminal and there were no proposals to use this pipeline at this time for the supply of gas to any user.


We also wish to draw the attention of the Board to the fact that one of the boreholes in the peat in the site struck water, the quantity of waster was not defined, therefore the mitigation measures required could not be assessed making the proposal incomplete.


We stand over all of our original submission and submit that the developer has not provided any evidence to mitigate anything in that submission.
